Join us on Wednesday, April 28, 2021 at 5:00 PM ET for a Zoom video seminar on a Equitable Distribution of Active v. Passive Exempt Assets. 1.2 CLE Credits approved in Family Law. 

This one-hour seminar will focus on the various legal theories behind the equitable distribution of the growth of otherwise exempt assets – comparing results of passive assets vs. active assets vs. hybrid assets – those which have arguably increased in value due to both passive and active growth.

Our discussion will start with outlining the facts of a high income and asset case, identifying the issues to be addressed, attempting to define who has the burden of proof of each element of the claims, and making each party’s respective arguments to the court.

We will explore how attorneys and experts, inspired by footnote 4 of Painter v. Painter, have developed creative arguments to buttress their positions of immunity or inclusivity of growth.  Then we will apply some of those theories to the case study at hand.
